Tips For Home Buyers: Do I Need Title Insurance?

Here is a great, short blog from Anita in Georgia on TITLE INSURANCE. Should you get title insurance when purchasing a property in the Louisville, Kentucky area?

HELL YES! I tell all of my buyers that they do not have a choice! Of course, if you finance a home any lender will require you to get title insurance, however if you are paying cash then it is not required...then why would you get it?

In a nutshell, it pays for itself. It covers your butt in case their was a previous defect in the chain of title (ownership). You wouldn't want to purchase a home and then lose it 2 years down the road because the person the sold it wasn't actually the true seller, would you??

Tips For Home Buyers: Do I Need Title Insurance?Unsure if the extra expense is worth the cost, a frequently asked question I hear from Houston County GA buyers is, "Do I need title insurance?".  Title insurance provides protection for the policy holder if another entity makes a property title claim.

In Georgia, there are 2 types: 

  • Lender Title Insurance protects the lender, is for the amount financed, and is required as a condition of the loan.
  • Owner Title Insurance is optional, a one-time expense, made available at closing, and remains in force as long as you retain an interest in the property (it also remains in effect if heirs retain an interest after the original owner has died)

Do I Need Title Insurance?

Technically, Owner Title Insurance is not required. However, I recommend all my buyer clients get Owner Title Insurance to ensure they are protected in-case an unknown risk such as forged documents, public record mistakes, title defects, and even back taxes and/or liens comes to light after they have purchased the property. In some cases, it may be determined they do not legally own the home.

Having Owner Title Insurance will help alleviate title issues that arise, pay for a lawsuit defense if necessary, and protect the buyer from financial loss up to the policy dollar amount.

Sean, great advice.  Most buyers do not realize how important title insurance is but we do everything we can to convince them of it's importance.  I've had 3 instances where my clients had to put a claim against that policy, nothing big, but still the peace of mind was worth it.
